Eligibility for Adjustment

There are a number of different requirements that must be met for someone to be eligible for an adjustment in status. Many of these requirements are determined by the eligibility category that someone chooses to petition through. Generally, these eligibility categories are:

  • Family – For family-based petitions, you are required to have a U.S. citizen or lawful permanent resident sponsor you. Both the sponsor and petitioner must meet certain requirements. The application and approval will be dependent upon the relationship between the two parties. Those falling into the category of immediate relatives of U.S. citizens usually have the quickest path to approval, and there is no limit to the number of visas issued. Others may fall into family preference categories, which contain different annual caps and can have lengthy delays in approval.
  • Employment – In this category, it is generally a business that acts as a sponsor and fills out forms to attempt to get you approved to have legal status in the country. That way, you can be fully eligible to work in the U.S. There is also a petition for entrepreneurs who plan to invest large amounts of capital in a U.S.-based business venture.
  • Asylum – Asilo is an option for those who have reason to fear persecution if they return to their homeland. They must be able to credibly show why they fear persecution. That persecution also must be something severe and based on race, religion, nationality, political opinion, or belonging to a particular group. Additionally, that persecution must be at either the hands of the government or someone that the government is unwilling or unable to stop.
  • Special Programs – There are some classes of immigrants who may be able to apply through a special program. An immigration lawyer can help you understand if any of these may apply to you.

There are things that could also lead to ineligibility, even if you meet the requirements for one of the categories above. Some of the other factors considered include:

  • Current legal status as an immigrant
  • Whether you entered the country illegally
  • If there are pending removal proceedings
  • Approval of prerequisite petitions
  • Criminal history

Adjustment Process

The adjustment of status process can vary a little bit depending on your circumstances, but it generally follows a basic sequence. There’s no way to be certain about exactly how long the process will take but, in most cases, a decision is made within eight to fourteen months. The steps to an adjustment in status are generally:

  • Determining what category you will be filing under
  • Filing an immigrant petition, typically filed by your sponsor if your category requires one
  • Checking for visa availability and whether the visa you are applying for has met its cap for the year
  • Filing Form I-485
  • Biometrics Services Appointment, which involves getting fingerprinted and photographed, in most cases, and occasionally getting DNA taken as well
  • USCIS interview
  • Receiving a final decision in writing
